Tulsa's FreedomFest features one of the largest free fireworks displays in Oklahoma, along the banks of the Arkansas River, and it's happening Friday night.

Some changes to FreedomFest for 2025 include new viewing locations. Organizers are launching fireworks further north, so those used to watching the show from the south will need to find a new spot.

Good news for Fest attendees this year: traffic is expected to flow more smoothly this year. With nearby construction projects complete and the fireworks no longer being launched from the 21st Street Bridge, road closures will be minimal.

What is Folds of Honor?

TULSA, Okla. — Right in the middle of midtown, one block from the busy intersection 41st and Yale, at 40th and Yale, viewers contacted FOX23 News about this: a Jake’s Fireworks stand. So did Peggy Mihos.

“I was going to Reasor’s, and I saw a firework stand in the city limits. And I've lived in Tulsa for 45 years, and I've always been told you can't do that in the city limits,” Mihos said.

Peggy’s right. Here’s the city ordinance about that:

“It shall be unlawful and a misdemeanor offense for any person to possess, manufacture, store, sell, handle or use any fireworks within the corporate limits of the City of Tulsa, without first having procured an operational permit from the fire code official.“

Basically, you need a permit to sell fireworks, and the City of Tulsa says it won’t permit anyone to sell fireworks, not an individual, nor a company.

“People have rights, and we should be blessed with having our freedoms, but if you're doing this just to make a buck and you're breaking the rules, that's just not right.

I went to the Jake’s Fireworks stand and asked about it.

The person working at the fireworks stand told me she just works here and doesn’t know the rules but did point out paperwork taped to a table.

The paperwork says the Jake’s stand does have a permit but not from the City of Tulsa, from Muscogee (Creek) Nation.

“If they're there legally and they've got the permission from the city and the ordinance says you can be there, I have no problem with that. Everybody has the right to make money, but as long as it's above board,” Mihos said.

I asked the City of Tulsa about it. A city spokesperson said because this particular land is considered “restricted Indian land”, city laws don’t apply here, not on the corner at 40th and Yale that backs up to a neighborhood.

“Tribal land, my gosh, we're all on tribal land. If you think about it,” Mihos said.

But I found out there’s a difference between tribal land and restricted tribal land.

You can see a map, most of Tulsa, south of Interstate 244 is on Muscogee (Creek) Nation tribal land. But another map shows what’s called “restricted Indian land.”

The city told me: “There are a few scattered parcels of restricted Indian land around the city, as well as some land held in trust for tribes.”

“Who's going to move in there next? You know, nobody's going to question it, because according to them, they're on tribal land. Again. I have no problem with people being on tribal land. I go to the casinos,” Mihos said.

Here’s the federal law: “none of the laws, ordinances, codes, resolutions, rules or other regulations of any State or political subdivision thereof limiting, zoning or otherwise governing, regulating, or controlling the use or development of any real or personal property … shall be applicable to any such property leased from or held or used under agreement with and belonging to any Indian … that is … subject to a restriction against alienation imposed by the United States.” 25 CFR §1.4.

It basically says laws like the City of Tulsa laws don’t apply on restricted Indian land.

I called the Tulsa Fire Department and found out Peggy’s not the only one who called the Tulsa Fire Marshal.

“When I talked to the city fire marshal, they didn't have a record of them being there, except they had heard about it, and they were going to investigate it further,” Mihos said.

The Fire Marshal says he doesn’t approve of this fireworks stand being in Tulsa, but he doesn’t have jurisdiction. He also said it’s not just about *selling* fireworks. You’re not even supposed to possess them in Tulsa.

“You can't have fireworks in the City of Tulsa. As a person, I can go to they have a location West Skelly. It's out of the city limits. I can go purchase it. But once I come in city limits, I'm breaking the law. You're not supposed to even have them. So people that go over there and then cross into this parking lot, they could receive a fine,” Mihos said.

Even though the fire marshal can’t do anything about the selling of fireworks right here, because it is still against the fire code to possess them, the Fire Marshal said he did give Jake’s this sign and asked them to post it. It warns about “possessing” fireworks and says that goes against the city’s fire code.

Theoretically, the fire marshal could sit across the street and cite people right after they bought the fireworks and stepped off the property.

Jake’s is out of Pittsburg, Kansas. I called to ask about the permit and why they decided to set up here, but I haven’t heard back yet.

“Jenks has places you can go. Broken Arrow. Owasso; their rules are different, but we're in city, the city limits. I mean, I'm a Tulsan. 45 years I've been a Tulsan, lived in Tulsa proper, and I'm just, I guess I just get upset,” Mihos said. “I just want a safe place. “

If you get caught shooting or just having fireworks in the City of Tulsa, you could get $220 ticket, plus you have to go to court.

The Tulsa Fire Marshal, Chuck French, released a statement regarding the firework stand.

“The Tulsa Fire Department is aware of the firework stand operating on a parcel of land located within Tulsa city limits. This specific property is classified as restricted Indian land, which places it under federal jurisdiction and limits the City’s authority to regulate its use under local ordinances. However, it’s important to emphasize that outside of restricted Indian land, the sale, possession, or use of fireworks within Tulsa city limits is strictly prohibited by city ordinance.

Our Code Enforcement team made contact with the property owner to inform them of Tulsa’s fireworks restrictions. While we are not establishing a physical presence at the site due to staffing limitations, we remain committed to public safety and education. If a citizen is caught using fireworks within the city limits, they may receive a $220 fine and a summons to court. If injuries or property damage occur, those consequences can become significantly more serious.

This isn’t just about enforcement, it’s about preventing injury, fires, and property loss. In the week surrounding last year’s Fourth of July, Tulsa Fire responded to more than 100 emergency calls likely tied to illegal fireworks, including house and apartment fires, burn injuries, and grass fires. Each of these incidents represents a risk to families, firefighters, and neighborhoods.

We understand that celebrating Independence Day is important, but fireworks are not worth the danger they pose, especially when there are numerous professional fireworks shows around Tulsa designed with safety in mind. We ask all residents to do their part: leave the fireworks to the professionals, and if you plan to consume alcohol or medications that impair judgment, please do so responsibly. Our priority is keeping Tulsa safe this holiday season.”

Midtown Hardware is closing for good after 46 years in business. The owner says he has enjoyed running the store but he has no other choice.

A Tulsa hardware store that has been in business for 46 years is closing for good in July. The owner says he has enjoyed running the small business, but he has no other choice.

"I feel nostalgic," said DJ Day, store owner of nearly five years. "Some days I feel sad, then some days it's just inevitable and moving on just seems like the right move."

Day says the biggest competitor is the convenience of online shopping. The store held on during the pandemic and even after a car recently smashed through the front of the building.

Heavy rainfall from the spring destroyed the roof and flooded the building. The cost of making repairs is too much.

"God speaks in floods a lot," said Day. "I've got a biblical notion that it's probably time to close it down."

Day says he will miss the conversations with customers and trying to help them out with whatever they need. He is unsure of his long-term plans, but has something in mind after closing the store.

"A vacation," he said. "I'm going to take at least four or five days off in a row. I can't wait."

"They've always been good to this neighborhood," said James Frederick, a frequent shopper of more than 20 years. "It's going to be hard to see them go."

Frederick said he always tries to support local businesses and Midtown Hardware has been convenient since he lives a block away from the location.

Discounts of up to 70% are being offered on the remaining product. Day plans to close the store for good on July 2nd.
